These terms govern the contract between you and testimea for online IT certification practice exams (a digital service / digital content). We sell to customers worldwide. Because we are established in the Slovak Republic, European Union consumer law applies to consumer contracts, in particular Act No. 108/2024 Coll. on Consumer Protection and the rules on digital content and digital services. Mandatory consumer rights in your country of residence cannot be waived.

2. The service

testimea provides online practice exams in two modes: a timed Exam simulation and an untimed Practice attempt with immediate feedback. They are study tools for educational purposes only.

  • They are not official certification exams.
  • We are not affiliated with, endorsed by, or a partner of the certification vendors whose exams you may later sit.
  • A pass on testimea does not mean you are certified and does not guarantee that you will pass any official exam.

Functionality. After purchase you get lasting access on your account to start Exam or Practice attempts, move between questions, flag items, take notes, report a problem with a question, submit, and review past results. Unfinished attempts are not kept; if you leave before you submit, the next start begins from the beginning. In Exam mode a time limit applies, as shown on the product and exam pages. Practice mode has no countdown; you can check an answer and read the explanation before you finish. Reporting a problem does not pause the Exam timer.

Compatibility. You need a current desktop or mobile browser, JavaScript enabled, and a stable internet connection. We do not supply software to install.

3. Who may buy

You must be at least 18 years old and able to enter a contract. If you buy as a consumer (not for your trade or profession), you have the consumer rights described below. If you buy as a business, those extra consumer rights may not apply, but the rest of these terms still do.

4. Account

Checkout creates an account so we can deliver the exam. You must provide accurate details, keep your password confidential, and tell us if you think someone else has used your account. You are responsible for activity on your account, except where we caused the problem.

5. How the contract is formed

Product pages are an invitation to order. You place a binding order when you complete checkout and click the button that confirms an obligation to pay. The contract is formed when we accept the order by taking payment and sending an order confirmation to your email (a durable medium). We may refuse an order (for example suspected fraud) and will refund any amount already charged.

Access is normally granted immediately after successful payment. That is when we start supplying the digital content.

6. Price and payment

The price shown at checkout is the total price for that exam, including VAT where VAT is due. There is no shipping cost. Payment methods are those offered at checkout. The purchase is a one-time payment for that exam, not a subscription, unless a product page clearly says otherwise.

For EU consumers, VAT on digital services is charged according to applicable EU VAT rules (including the One-Stop Shop scheme where we use it).

A one-time 50% discount code may be offered after you send feedback from the leaving prompt. It applies once, to full-access exams only, for 14 days. It does not apply to a trial and it does not combine with a trial upgrade credit or another coupon. The code is shown on screen when it is created.

7. Licence and acceptable use

We grant you a personal, non-exclusive, non-transferable licence to take the purchased practice exam on testimea for your own study. You may not copy, scrape, record, share, resell, publish, or otherwise distribute exam questions, answers, or explanations. You may not attempt to break, overload, or reverse engineer the platform, or use it to cheat on any official exam.

If you seriously breach this section, we may suspend access. That does not affect your statutory rights for a defective service, or any other rights that cannot be limited by contract.

8. Right of withdrawal (14 days)

If you buy as a consumer in the EEA, you normally have 14 days from the day the contract is concluded to withdraw, without giving a reason, under Act No. 108/2024 Coll. and the EU Consumer Rights Directive.

Practice exams are digital content supplied otherwise than on a tangible medium. You lose the right of withdrawal once we have started supplying the exam, but only if, before checkout, you:

  • expressly requested that we start supplying the digital content immediately, and
  • acknowledged that you would lose the right of withdrawal once supply starts, and
  • we confirmed this to you on a durable medium (the order email).

If those conditions are not met, you keep the 14-day right even after access is granted. If we failed to inform you about the right of withdrawal, the period is extended as required by law (up to 12 months plus 14 days).

To withdraw while the right still applies, use the Withdraw from contract page, or email support@testimea.com with a clear statement (a model form is on that page). We will refund all payments for that contract within 14 days, using the original payment method unless we agree otherwise.

9. Statutory liability for defects

We must supply the exam as described and in conformity with the contract and with objective requirements for digital content (including functionality, security, and updates that are necessary to keep it in conformity). For consumers, this statutory liability cannot be excluded.

If the exam is not supplied, or is defective, you may require us to bring it into conformity. If that is impossible or we fail to do so, you may request a price reduction or terminate the contract and obtain a refund, as provided by Slovak and EU digital-content rules. For consumers, a lack of conformity that appears within two years of supply is presumed to have existed at the time of supply unless that is incompatible with the nature of the content.

10. Availability

We aim to keep the service available. Short interruptions for maintenance, hosting issues, or events outside our reasonable control may happen. Planned maintenance will be kept as short as we reasonably can. This section does not limit your statutory rights if the service is not in conformity.

11. Liability

Nothing in these terms limits liability for death or personal injury caused by negligence, fraud, or any liability that cannot be limited under applicable law. We are not liable for failing an official certification exam, or for study results that depend on your own preparation. We are not liable for loss that was not reasonably foreseeable, or for business losses if you used the service as a consumer.

12. Privacy

We process personal data as described in the Privacy Policy.

13. Changes

We may update these terms for legal, technical, or service reasons. The “Last updated” date will change. For existing consumer contracts, material changes will not apply retroactively unless the law allows it or you agree. If you have an account, we may notify you by email or a notice on the site.

14. Governing law and disputes

These terms are governed by the law of the Slovak Republic, except that this choice of law does not deprive you, as a consumer, of the protection of mandatory provisions of the law of the country where you live.

Consumers may bring proceedings in the courts of Slovakia or in the courts of their country of residence. We may bring proceedings against a consumer only in the courts of the country where that consumer lives, where the law so requires.

You may also complain to the Slovak Trade Inspection (Slovenská obchodná inšpekcia) or use an alternative dispute-resolution body competent for your country. Website of the Slovak Trade Inspection: https://www.soi.sk.
